Terms of Service

These terms ("Terms") govern your use of Niche Moat — including the website at nichemoat.com, the dashboard at app.nichemoat.com, the Chrome extension, and related APIs (collectively, the "Service") — operated by Emporium Edge LLC, 1032 E Brandon Blvd, Brandon, FL 33511, USA ("we", "us"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract under applicable law.

2. Account and license

We issue you a license key tied to your email address. You're responsible for keeping it confidential. License keys are limited to the device count specified in your plan. Sharing your license beyond your plan's device cap is prohibited.

3. Acceptable use

• Don't reverse-engineer, decompile, or attempt to extract source from the extension or APIs.
• Don't resell, sublicense, or redistribute the Service or generated reports as a paid service to third parties without written permission.
• Don't use the Service to violate Etsy's, eRank's, or any other third party's terms of service.
• Don't use the Service for unlawful, harassing, or abusive purposes.
• Don't attempt to overload, probe, or interfere with our infrastructure.

4. Third-party services

The Service relies on your existing eRank and Etsy accounts. You're responsible for complying with their respective terms of service. We are not affiliated with, endorsed by, or sponsored by Etsy, Inc. or eRank, LLC.

5. Payments and renewals

Payment is required up-front for each billing period. We do not store card data and do not auto-renew. Each renewal is a manual action on your part. Prices are displayed on the Pricing page and may change with notice for future periods.

6. Refunds

See our Refund Policy. In short: 7-day no-questions refund on first paid period only.

7. Intellectual property

The Service, including the extension, APIs, dashboard UI, and underlying code, is our property. You receive a non-exclusive, non-transferable license to use the Service for your own internal Etsy research while your subscription is active. Reports generated for you are yours to use commercially.

8. User-generated content

If you submit feedback, suggestions, or feature requests, you grant us a perpetual royalty-free license to use them without obligation.

9. Service availability

We aim for high uptime but don't guarantee uninterrupted service. Planned maintenance will be announced when possible. We're not liable for downtime caused by upstream providers (Cloudflare, Etsy, eRank, hosting).

10. Termination

You can stop using the Service at any time by not renewing. We may suspend or terminate accounts that violate these Terms, with or without notice. On termination, access to the dashboard and extension stops; reports stored on our servers may be deleted after the retention period of your last active plan.

11. Disclaimers

The Service is provided "as is" without warranties of any kind. We don't guarantee that any keyword, concept, or listing will result in actual sales or profitability. Niche research is one input among many — your business decisions are your own.

12. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We're not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data.

13. Indemnification

You agree to indemnify and hold us harmless against claims arising from your misuse of the Service or violation of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to that venue.

15. Changes to these Terms

We may update these Terms. Material changes will be announced by email and on this page. Continued use after a change means you accept the updated Terms.
